By accessing or using this Site, viewing our menus, or submitting an inquiry, you agree to be bound by these Terms of Use ("Terms") and our Privacy Policy. If you do not agree to these Terms, please do not use this Site.

2. Online Ordering, Payments, Delivery, Pricing & Refunds (Toast / order.online)

To provide convenient online pickup and delivery across our 15 Southern California restaurants, clicking "Order Online" or selecting a restaurant order link directs you to order.online, an external ordering platform operated by DoorDash, Inc. and integrated with our restaurants' Toast Point-of-Sale (POS) system. Please review the following important operational terms before placing an order:

• Who Processes Your Order & Payment: Online checkout and payment card transactions placed through order.online are processed by DoorDash, Inc. as the ordering platform merchant/processor. Tacos Gavilan does not collect or store your payment card numbers on tacosgavilan.com. Once your payment is authorized on order.online, your order details are transmitted via Toast POS to the selected Tacos Gavilan restaurant for kitchen preparation.
• Who Manages Delivery: Delivery orders placed through order.online or third-party delivery marketplaces are fulfilled and transported by independent third-party delivery couriers coordinated by DoorDash, Inc. (not by Tacos Gavilan employees).
• Menu Pricing & Platform Fees: Menu descriptions and photographs on tacosgavilan.com are for general informational purposes. Prices, item availability, taxes, service fees, delivery fees, and optional courier tips on order.online or third-party delivery apps may differ from in-restaurant dining prices. The final itemized price and fees displayed on the order.online checkout screen prior to payment govern your online transaction.
• Store Operating Hours & Closed Locations: Operating hours vary by restaurant location (see /locations/). If a restaurant is closed, experiencing a temporary equipment/utility interruption, or out of a specific ingredient, order.online disables ordering for that store or item, or may cancel/adjust an affected order in accordance with platform procedures.
• How to Request a Refund or Report an Incorrect / Missing Order:
  • For Delivery or Online Orders Placed via order.online / DoorDash: Please use the automated "Help" / "Get Help" link in your order.online / DoorDash digital confirmation receipt to report missing items, delivery issues, or refund requests directly to DoorDash order support, or call the fulfilling Tacos Gavilan restaurant directly using the phone number listed on /locations/.
  • For In-Store Pickup or Restaurant Service Questions: Please speak with the restaurant manager on duty at the location where your order was prepared, call the restaurant directly (/locations/), or submit a Customer Experience message through /contact/ with your order receipt details.
• Third-Party Delays & Independent Platform Policies: Tacos Gavilan does not control and is not responsible for independent third-party courier delays, traffic, weather delays, or technical outages on order.online or DoorDash, nor do we control the independent Terms & Conditions or Privacy Policy of DoorDash, Inc. or Toast, Inc.

3. Food Allergen, Ingredient & Cross-Contact Notice

Important Food Safety & Allergen Disclosure: Please read the following carefully before ordering or consuming our food:

• Ingredients & Menus May Change: Recipes, ingredients, suppliers, and menu items across our restaurants may change periodically without prior notice.
• Shared Kitchen Facilities & Cross-Contact Risk: Tacos Gavilan restaurants prepare food from scratch in shared commercial kitchens using shared grills, fryers, prep tables, utensils, and cooking oil. Common food allergens—including wheat/gluten (flour tortillas, bread), milk/dairy (cheese, crema, champurrado), soy, eggs, sesame, peanuts, tree nuts, fish, and shellfish—may be present in our kitchens or supplier facilities. Because of shared preparation environments, we cannot guarantee that any menu item is 100% free of any allergen, and there is always a risk of cross-contact.
• Guest Responsibility to Consult Before Ordering: Guests with food allergies, celiac disease, or dietary sensitivities must inform restaurant staff and consult with the restaurant manager on duty before placing an order. Current item availability and ordering descriptions are available directly at your local restaurant or on order.online.

4. Intellectual Property & Permitted Use

All content on this Site—including the Tacos Gavilan name, logos, eagle emblems, food photography, menu descriptions, graphics, text, and code—is owned by or licensed to Tacos Gavilan and protected by United States copyright, trademark, and intellectual property laws. You may view and use the Site solely for personal, non-commercial use in learning about our restaurants or placing food orders. You may not copy, scrape, reproduce, republish, or exploit any part of this Site for commercial purposes without our prior written consent.

5. Acceptable Use & Contact Submissions

When using our Site or submitting our Contact Form, you agree not to: (a) submit false, defamatory, or fraudulent messages; (b) submit sensitive personal information (such as Social Security numbers, payment card numbers, or medical data); (c) impersonate another person or submit unauthorized requests on another person's behalf; or (d) attempt to bypass rate limits, inject malicious scripts, or interfere with the security or availability of our Site.
